Mr. O.P. Khaitan, (Founder Member)

Mr. O.P. Khaitan is the founder member of the Firm. After practicing an illustrious career in advocacy spanning more than 23 years with the law firms of Khaitan & Co. and Khaitan & Partners, Mr. O. P. Khaitan established his own law firm, O. P. Khaitan & Co. in 1990. He is an Advocate-on-Record of the Supreme Court of India and an Attorney-at-Law. He is also a recipient of Bell-Chambers Gold Medal from Calcutta High Court. He specializes in successful resolution of civil and commercial disputes through arbitration and alternate dispute resolution measures at national and international level. He handled and achieved success in several arbitrations relating to oil & gas, commodities, construction, engineering, international trade and government and private contracts. He has conducted number of arbitrations of ICC Paris, UNCITRAL, American Arbitration Association, London Court of Arbitration, GAFTA, FOSFA and other International Arbitration Associations. In addition Mr. Khaitan also acts as an arbitrator in arbitration matters.
Mr. Khaitan also heads the Firm's national and international litigation practice. Besides being widely recognized as a leading arbitration and litigation lawyer, he is also acknowledged for his corporate and commercial laws practice. He is an advisor to the corporate clients for over 41 years. He advises clients on foreign collaborations, joint ventures, investments in India & abroad, mergers & acquisitions, international banking and finance, international trade and insurance laws. He has developed a wide client base, including big corporate groups, bankers and insurers throughout the world. He is also a director in many private and public limited companies.
Mr. Khaitan is a member of various international and national organizations including International Bar Association, LAW ASIA, Supreme Court Bar Association, Bar Council of West Bengal, Delhi High Court Bar Association, Federation of Indian Chamber of Commerce & Industry; Indian Council of Arbitration. He is an author and speaker on several law and business related issues. Mr. Khaitan has instilled, nurtured and emphasized in his team the importance of teamwork, operations efficiency, timeliness and cost-effectiveness. Mr. A.T. Patra, (Senior Partner)
(M.A., LL.M.)

 

Mr. Patra did graduation with Honors in Political Science from Ravenshaw College, Utkal University; M.A. in Political Science and LL.M. from University of Delhi. He was enrolled as Advocate in the Bar Council of Delhi in the year 1970 and started his practice in the chambers of eminent jurist late Dr. L. M. Singhvi. He joined Khaitan & Co. in 1977 and has been working in O P Khaitan & Co. since 1990, when the Firm was started. He has been dealing in litigation as well as Corporate Matters with special interest in Constitutional Law, Corporate Laws, Arbitration and Taxation. He is a member of Supreme Court Bar Association. Mr. Patra is a senior member of the Firm specialized in national and international litigation and arbitration. He has wide ranging experience in all aspects of corporate and civil litigation in the Supreme Court of India, State High Courts and Judicial & Quasi-judicial Tribunals.

 

Mr. Gautam Khaitan, (Managing Partner)

Mr. Gautam Khaitan is the Managing Partner of the Firm and heading the Corporate Division. He has handled various corporate and litigation work for various leading multinational and national companies, banks and financial institutions all over the world including but not limited to mergers, demergers, acquisitions, joint ventures, structuring transactions, collaborations, Facility Documentation, External Commercial Borrowings, arbitrations. He is also holding directorships in various companies of leading corporate houses. Mr. Khaitan has vast experience of more than 22 years in Power, Oil, Telecommunication, Mining and Infrastructure Sector. He has also worked internationally on major mergers and acquisitions and corporate finance transactions. He has regularly acted as lead negotiator on legal and contract issues for various clients and has coordinated a range of specialist advice as required, working with business and financial advisers and generally as part of a team focussed on complex projects. The clients benefit from his diverse experience and expertise, and particularly his commercial approach and problem solving capabilities.

 

Ms. Suparna Sachar, (Senior Partner)

Ms. Suparna has acquired substantial expertise in representing various domestic and international clients in joint ventures, private equity investments, acquiring stakes in Indian companies, advising foreign investors on exit strategies for exiting Indian markets, Business and Asset Sales, Due Diligences, Exchange Control Laws, Security Laws and various cross border transactions. She has been advising investors on their investment strategies in India and abroad and is involved in drafting and negotiating transaction documents for such investments. Her tax experience includes advising on cross border tax structuring and issues such as creation of permanent establishment, obligations in relation to withholding tax and transfer pricing. She has assisted clients ranging from start-up companies to some of the multinational companies in a broad spectrum of industry ranging from automobiles, defence, energy, information technology, infrastructure, pharmaceuticals, telecommunications and Hospitality. She has also advised corporate and business entities in their day to day compliances, secretarial matters, contractual and labour matters. She has acquired over the years a broad-based commercial, regulatory and transactional experience.

 

Ms. Bharti Badesra, (Senior Partner)

The diverse areas of her legal practice include commercial and criminal litigation, arbitration, unfair competition and trade practices and employment laws. She has been regularly appearing before State High Courts, Supreme Court and other judicial and administrative authorities representing various multi-national and domestic companies and successfully handled cases many of which have been ground breaking. In addition to the litigation service, she has also been providing advisory services by way of legal opinions and drafting of replies. She has also been actively involved in arbitrations and intellectual property matters including patent, trademark, copyright, design and geographic indication registration and prosecution (opposition and infringement) for enforcement of IP rights.

 

Mr. Nipun Malhotra, (Senior Partner)

Nipun Malhotra, has a vast experience of being both a practicing attorney and as an in-house counsel general reporting to the Board of Directors/Chairman of the Corporation. Before rejoining back with O P Khaitan & Co., he has been advising DLF Limited, the largest real estate corporation in India, as its Senior Vice President Legal. While at DLF, Nipun Malhotra has been looking after real estate purchases, due diligence, land acquisitions, lawsuits, business development agreements for both residential and commercial complexes.
Prior to joining DLF Limited, Nipun Malhotra was Vice President Legal Affairs and Group General Counsel at EIH Limited (The Oberoi Group). While with the Oberoi Group, Nipun Malhotra provided pan India litigation support and supervision, was responsible for strategic planning and handled corporate and commercial contracts, etc.
He has been actively engaged and has represented/pleaded for different corporate bodies, organization/individuals in different courts/arbitration tribunals/ Tax Tribunals/ Labour Tribunal and Environmental Tribunals. He has closely worked with various corporations and successfully closed various transactions including resolving potential industrial disputes , attending to foreign management funds etc. He has been an active participant in various extra-curricular activities during his student days and is an avid reader.

 

Ms. Roopa Dayal , (Partner)

Ms. Roopa was enrolled with Bar Council of Delhi in September 2000 and is associated with a Firm since January 2003. While working with the Firm, she had the opportunity to handle hard core litigation relating to recovery matters, injunction, writs, company winding up, Trade-mark matters, matters related to Negotiable Instruments Act, Arbitration etc. She has been drafting and filing suits, petitions, SLP, various Applications including Application seeking interim relief, Appointment of receiver or Arbitrator, Statement of claim, statement of defense, counter-claims, notices etc. She is also handling all kind of litigation in civil side, Original Side, Recovery cases in Debt recovery Tribunal, Intellectual property matter (Trade-Mark), Arbitration Matters and litigation in Consumer Courts and MRTP and in the Appellate forums of the above said.

 

Mr. Manish Jain, (Partner)

Manish is a first class graduate in commerce and law. He is an alumni of the prestigious Shri Ram College of Commerce and completed his law graduation as a topper from Law Centre II, Faculty of Law, Delhi University in the year 2005. He has been associated with the firm since the past 10 years and has wide experience in advising clients across sectors on various corporate and commercial matters including overseas acquisitions, foreign direct investments, joint ventures and collaborations, cross border deal structuring, private equity, and syndicated loans.

 

Dr. Praveen Alok , (Partner)

Dr. Praveen Alok has specialization and experience of ten years covering all aspects of Real Estate Laws and practice. He has been drafting and vetting all kinds of complex documents relating to real estate transactions including company takeovers, acquisitions, etc. He has been independently conducting due diligences for real estate projects of various reputed real estate groups, banks and financial institutions, residential, commercial, institutional and industrial Projects. He has successfully handled and closed commercial transactions involving real estate matters of reputed clients. He has handled various property development collaborations, builder buyer agreements, brokers agreements, other ancillary documents involved in property development by developers, etc. with corporates.. He has been appearing before revenue courts, liaison with revenue officials like Patwari (Talathi), Tehsildar, Sub Registrar, collector (stamps), Sub Divisional Magistrate, Deputy Commissioner etc., getting execution and registration of documents before sub-registrar, getting mutation and freehold of properties done, resolving other issues with the local authorities in property/company acquisitions.

 

Mr. Amlan Jyoti Borah, (Principal Associate)

Amlan has represented various domestic and international clients in investments and acquisitions. He specializes in cross-border and joint venture transactions. He has acted as the lead associate responsible for various aspects of transactions, including drafting and negotiating various legal documents, including share purchase and shareholders agreements, joint venture agreements, miscellaneous commercial agreements, conducting due diligence for multiple acquisition transactions.
Amlan has been advising clients with respect to general corporate matters, including infrastructure transactions. He advises clients on all aspects of the regulations governing foreign investment in India including providing solutions to issues arising out of government policy including the type of entity to be set up in India.
Amlan also advises clients in obtaining regulatory approvals from various authorities including Foreign Investment Promotion Board, Reserve Bank of India and various Government Departments.

 

Ms. Tanya Khare, (Principal Associate)

Enrolled in 2007 with the Bar Council of Delhi, she has commenced her legal career with the Firm and has been associated since January 2009. She is an integral part of the litigation team where she represents the firm before prestigious forums like the Hon'ble Supreme Court, High Court, Tis Hazari, Patiala House, Saket Court and the other Judicial and Quasi- Judicial tribunals as well as for several proceedings involving alternative dispute resolutions like Arbitrations and Mediations. She deals with matters of the civil side involving statues like Civil Procedure Code, Arbitration and Conciliation Act, Contract laws, Constitutional Laws, Debt Recovery matters, Negotiable Instruments Act, Property Law, Intellectual Property Law. Her other engagements include drafting various legal documents required in litigation matters like Petitions, Claims, Applications, and Notices etc. She has been involved in briefing and assisting various Counsels and Designated Senior Advocates and has given oral and written advice to our vast pool of national and international clients.
